Alabama takes termite treatment fraud claims seriously

The idea that termites may be destroying your Alabama home’s structural integrity may strike fear in your heart. After all, real estate is often a person’s most important asset or investment. Termite companies know this but still often fail to properly treat homes as is required by law and product labels. Not every state takes termite treatment as seriously as Alabama. The state’s Department of Agriculture and Industries has the authority to enforce state laws and regulations regarding the use of pesticides, the maintenance of proper records regarding pesticide use, and the methods of application of the pesticides. According to Alabama law, a Pest Control Company representative may be guilty of a crime if they knowingly fail to abide by the laws and regulations of Alabama. You may file a consumer complaint form if you suspect that the termite company you hired is guilty of one of the following violations:

  • Performing substandard termite treatments
  • Performing treatments without issuing a termite contract
  • Failing to retreat an active termite infestation
  • failing to properly respond to a termite infestation, including treatment of your property in accordance with state regulations

To begin the investigation process, you will need to fill out and submit the written form provided by the Department of Agriculture. The form asks for information such as whether you signed a contract, the name of the salesperson who spoke to you, what services were involved, whether you have complained to the company and it has acknowledged your complaint, and whether you have consulted a lawyer.

You should also submit any documentation you may have from the company, such as the following:

  • Photographs
  • Diagrams
  • Letters
  • Contracts
  • Service tickets
