How can we fight failures to control termites?

Termites have been a problem in the Deep South since the first buildings went up. But the last few years have seen a resurgence of the destructive pest, with new colonies showing up and growing across the Gulf Coast.

Many businesses handle pest control, and a few in Alabama handle nothing but termite infestations in homes' woodwork. If their work is ineffective in mitigating termites, owners have recourse to get restitution.

What does Alabama do to protect homeowners?

The Alabama Department of Agriculture regulates the Pest control Industry in this state. Builders must also meet code requirements and require a proper pretreat of a home under construction.  If you are not getting a response from your termite company, you can file a consumer complaint with the State Department of Agriculture, and they will invesetigate the complaint and order the Pest Control Company to reevaluate the problem and treat in accordance with the State minimum requirements for treatment.

How can I protect myself?

Homeowners should always ask to see a company's or individual's pest control license from the Alabama Department of Agriculture. It is also best to insist on a contract that ensures damage repair in the case of a bad first treatment. Also, make sure that the contract specifies comprehensive treatment, and not merely defined treatments.  This should be designated in a bold printed block at the top of your contract. A full comprehensive treatment better insures against a future termite infestation.  If you do not receive an adequate inspection or treatment, a lawyer can help deal with addressing the responibilities of termite control companies or professionals who do not fulfill their legal obligations to homeowners.
