Construction Defect FAQ

The laws surrounding construction defect litigation in Alabama are complex and something few builders or property owners think about until they get involved in a dispute. The following are some frequently asked questions from our clients:

What are some examples of a construction defect?

Defects in a new building or remodel can arise due to negligence in the design phase, faulty materials or poor workmanship during construction. For example, a flaw in the design of a building can cause water to run from the roof into the wall. Shoddy materials used on the roof can also cause water damage, as can poor plumbing work that causes the pipes to leak.

Besides leaks, common types of defects include mold, cracks in the foundation and problems with the HVAC and electrical systems. These problems can make the building unfit for its intended purpose and potentially unsafe to inhabit.

Who is responsible for construction defects?

Depending on what happened in your particular case, the contractor, one or more of the subcontractors, the developer, the manufacturer of the defective materials (if any) and/or the architect could be liable. They could be liable for damages suffered by the property owner, which means they are legally responsible for compensating the owner.

Are there statutes of limitations on construction defect claims in Alabama?

Yes. State law imposes a two-year statute of limitation on claims against architects, builders and engineers. The clock begins ticking on the date the damage is or reasonably should have been first discovered, which for certain latent defects could be months or years after construction is complete. For other defendants, the statute of limitations is six years.
